Terms and conditions

1. Agreeing to these terms

These terms are an agreement between you and Corvell, a brand of 2057 Holdings LLC [CONFIRM legal entity] (“Corvell”, “we”, “us” or “our”). They cover your use of our website, including Corvell Atelier, Corvell Sartorial and Corvell Zapatería, your fitting, and anything you order from us (together, our “Services”).

By using the Services or placing an order, you agree to these terms and to our Privacy policy. If you don’t agree, please don’t use the Services.

2. Who can order

You must be at least 18 and able to enter a binding contract. We currently accept orders for delivery to [CONFIRM: United States only, or which countries]. Our website is run from Oklahoma in the United States. If you use it from somewhere else, you’re responsible for following your local laws.

3. Your account

Keep your login details private, and tell us straight away if you think someone else has used your account. You’re responsible for what happens under your account, and for making sure the details you give us are accurate and up to date. We may suspend or close an account that breaks these terms.

4. Custom orders

• Made for you. Each piece is made to order, using the size, measurements and design choices on your order.
• Your fitting. If you size through Corvell Atelier, we review your measurements with you and confirm your size before production starts.
• Ordering on your own. If you skip the fitting, your piece is made exactly to the size and measurements you give us. You’re responsible for those being right.
• When an order is accepted. Your order is an offer to buy. A contract is formed when we email you an order confirmation. We may decline or cancel an order, with a full refund, for example if something is unavailable, a price was shown in error, or we suspect fraud.
• Check before you confirm. Please check your design, size and delivery address before confirming. Once production starts, they can’t be changed.

5. Prices and payment

Prices are shown in US dollars [CONFIRM currency] and include the Corvell Atelier fitting at no extra charge. Sales tax, shipping and any import duties are shown at checkout. If a price is wrong on the website, we’ll contact you before going ahead.

Payment is taken by our payment processor when you place your order [CONFIRM: payment timing, deposit or full payment]. You confirm that you are allowed to use the payment method you give us.

6. Production, shipping and duties

• Lead times shown on the website are estimates, not guarantees. We’ll keep you updated as your piece moves through each stage.
• Corvell shoes ship from Spain. Corvell Sartorial pieces ship from [CONFIRM origin].
• Import duties and taxes: [CONFIRM who pays — paid by Corvell at checkout, or due from you on delivery].
• The risk of loss or damage passes to you when your order is delivered to the address you gave us. Please make sure someone can receive it.
• If your parcel is lost or arrives damaged, tell us within [CONFIRM] days and we’ll work with the carrier to put it right.

7. Changes and cancellations

You can change or cancel your order free of charge until production starts [CONFIRM: cut-off, e.g. within 24 hours of your order confirmation]. After that, the cloth or leather has been cut for you, so the order can’t be changed or cancelled.

8. Fit, returns and the First-Fit Guarantee

Because every piece is made for you, we don’t accept returns for a change of mind about the design, cloth, leather or colour.

Sized with Corvell Atelier: your first fit is guaranteed. If your piece doesn’t fit when it arrives, we alter it, by reimbursing a local tailor’s reasonable fees, or remake it at our cost if alteration can’t fix it. We pay all shipping on a guarantee claim. Tell us within 30 days of delivery. Shoes must have been tried on indoors only, with clean soles, and clothing must be unworn outside and not altered by anyone else. Ordered on your own: your piece is made exactly to the size and measurements you give us, and is final sale for fit. It isn’t covered by the First-Fit Guarantee.

9. Faults in workmanship

Faults in workmanship are always ours to fix, however you were sized. If something is wrong with how your piece was made, tell us within [CONFIRM] days of delivery, with photos, and we’ll repair, remake or refund it. This doesn’t cover normal wear, accidental damage, or damage from improper care or alteration by someone else. Nothing in these terms limits any rights you have under consumer protection law.

10. Materials, colours and photos

Leather and cloth are natural materials, so grain, texture and shade vary from piece to piece and may differ from swatches. Colours also look different on different screens. Photos on our website show the style of a piece. Yours is made in the cloth, leather and details you choose. Product details marked [CONFIRM] on the website are still being confirmed and aren’t a promise until they are.

11. Website chat

If we add a chat window to our website, it may be answered by an automated assistant that uses artificial intelligence, by a member of our team, or by both. The chat will say when you are talking to an automated assistant.

An automated answer can be incomplete or wrong. It is for general help only and doesn’t change these terms, set a price, or confirm a size or order. Sizes, prices and order details are binding only when they appear in your written order confirmation or are confirmed by a member of our team. Please don’t share payment card numbers or passwords in the chat. How we handle chat messages is explained in our Privacy policy.

12. Text messages (SMS)

If you give us your phone number on a form and tick the consent box, you agree to receive text messages from Corvell (2057 Holdings LLC) [CONFIRM legal entity], including fitting appointment confirmations and reminders, order and delivery updates, and replies to your questions. We send marketing texts only if you separately opt in to them.

• Message frequency varies with your orders and conversations with us.
• Reply STOP to opt out at any time. We’ll send one message to confirm, then no more unless you opt in again. Reply HELP for help.
• Message and data rates may apply, depending on your carrier and plan.
• Carriers are not liable for delayed or undelivered messages.

13. Using our website

You may use the website only for lawful purposes and in line with these terms. You agree not to:

• break any law, or use the website to send spam or unsolicited advertising;
• pretend to be Corvell, a member of our team, or anyone else;
• use robots, scrapers or other automated tools to access or copy the website without our written permission;
• introduce viruses or other harmful code, or try to get unauthorized access to the website, its servers or any connected system;
• overload, disrupt or attack the website, including by a denial-of-service attack;
• misuse the chat or any other interactive feature, including trying to make an automated assistant produce harmful, misleading or unlawful content.

We may change, suspend or withdraw any part of the website without notice, and we aren’t liable if it is unavailable at any time.

14. Our content and trademarks

The website and its contents, including text, images, designs, software and the arrangement of it all, belong to Corvell or our licensors and are protected by copyright, trademark and other laws. You may view and print pages for your own personal, non-commercial use. You may not otherwise copy, change, distribute or sell any of it without our written permission.

Corvell, Corvell Atelier, Corvell Sartorial, Corvell Zapatería, the Corvell logos and related names are our trademarks. Other names and marks on the website belong to their owners, and their appearance doesn’t mean those owners endorse us. Brand names in our shoe fit guide are used only to compare sizes.

15. Reviews, photos and other things you send us

If you send us a review, photo or other content for public use, you confirm that you own it or have the right to share it, and that it is accurate, lawful and not offensive. You give us a non-exclusive, royalty-free licence to use, edit and display it in connection with Corvell. We may remove any content at our discretion. We won’t publish your fitting photos or measurements without your permission.

Links to other websites are for your convenience. We don’t control those websites and aren’t responsible for their content or practices. Their own terms and privacy policies apply.

17. Disclaimers

EXCEPT AS EXPRESSLY STATED IN THESE TERMS, INCLUDING THE FIRST-FIT GUARANTEE AND OUR PROMISE ON FAULTS IN WORKMANSHIP, THE WEBSITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE”. TO THE FULLEST EXTENT THE LAW ALLOWS, WE DISCLAIM ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DON’T WARRANT THAT THE WEBSITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. THIS DOESN’T AFFECT ANY WARRANTIES THAT CANNOT BE EXCLUDED UNDER APPLICABLE LAW.

18. Limits on our liability

TO THE FULLEST EXTENT THE LAW ALLOWS, CORVELL, 2057 HOLDINGS LLC AND OUR AFFILIATES, SERVICE PROVIDERS, OFFICERS AND EMPLOYEES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE OR DATA, ARISING FROM YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM ABOUT AN ORDER IS LIMITED TO THE AMOUNT YOU PAID FOR THAT ORDER. THIS DOESN’T LIMIT LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW.

19. Your responsibility to us

You agree to compensate Corvell and our affiliates for claims, losses and reasonable costs, including legal fees, that arise from your breach of these terms or your misuse of the Services.

20. Governing law and disputes

These terms are governed by the laws of the State of Oklahoma, without regard to its conflict-of-law rules. If something goes wrong, please contact us first. Most problems can be fixed quickly. Any dispute that can’t be settled informally will be resolved in the state or federal courts located in Oklahoma [CONFIRM: court venue, or arbitration], and you and we consent to those courts’ jurisdiction.

If any part of these terms is found unenforceable, the rest still applies. If we don’t enforce a term straight away, we haven’t waived it. These terms, our Privacy policy, the First-Fit Guarantee and your order confirmation are the whole agreement between you and us about the Services.

21. Changes to these terms

We may update these terms from time to time. The “Last updated” date at the top shows when. Changes apply from when they are posted, but the terms in force when you placed an order apply to that order.
